These Terms of Use (the “Terms”) govern Roll the Moment, including its websites, event pages, photo and video tools, and related services (the “Service”). The Service is provided by Circle City Coders LLC (“Circle City Coders,” “we,” “us,” or “our”), based in Indianapolis, Indiana.
By creating an account, accepting these Terms during event creation or checkout, uploading media, or using the Guest gallery after being given access to these Terms, you agree to them. If you do not agree, do not use the Service. An “Organizer” is the account holder who creates an event. A “Guest” is anyone who uses an event link, including to upload or view photos or videos.
Eligibility and accounts
Organizers must be at least 18 years old and legally able to enter a contract. Guests must be at least 13 years old. A Guest under the age of majority where they live may use the Service only with a parent or legal guardian’s permission. The Service is not directed to children under 13, and children under 13 may not create an account, use an event link, or upload photos or videos.
You must provide accurate account information, protect your credentials, and promptly tell us at [email protected] if you believe an account has been compromised. Organizers must verify their email address before creating a new event.
If you use the Service for an organization or another person, you represent that you have authority to accept these Terms on their behalf.
The Service and event plans
Roll the Moment lets an Organizer create an event and share a QR code or link so Guests can upload photos and eligible short videos without an account. The Organizer can access original uploads from the time they are uploaded until the event cutoff and may enable or disable an optional Guest gallery.

Where video add-ons are available, an Organizer may select one optional video pack during event creation or through the narrow eligible upgrade described below:

Prices are in U.S. dollars and do not include applicable tax. Every plan has the same features. Paid plans provide only greater event capacity and a longer Organizer download window. A video pack may be purchased with any base plan, including Free. It does not change the base plan’s Organizer download window.
Before Guest access opens and before any photo or video reservation or upload has ever existed, an eligible event may make only these purchased changes: a Free base plan may be changed once to Plus, Premium, or Max by paying that plan’s full current price, and an event with no video pack or prior video-pack purchase may add exactly one Video 50, Video 100, or Video 200 pack at its full current price. An eligible Free event may purchase both changes together. These purchases are not credits or price-difference charges.
A Plus, Premium, or Max base plan cannot change to another paid tier. A video pack cannot be replaced, upgraded, or stacked with another pack. An event remains on its existing entitlement until verified payment applies the purchase. The resulting plan, video pack, price, capacities, upload limits, and retention period are then fixed for that event. In our discretion, we may separately grant an eligible, unused Free event a complimentary Plus, Premium, or Max plan without charge under the same pre-opening and no-media limits. That operator-authorized exception is not a purchased upgrade, credit, or promise of future grants, and it cannot add a video pack.
Before Guest access opens and before any media reservation has existed, the Organizer may change the event date or time zone, subject to account/date eligibility; the Service then recalculates the exact schedule. An eligible date correction releases the prior date allowance and consumes the newly selected date. After Guest access opens or any media reservation exists, the date and time zone cannot change. Photo and video capacities are independent. Pending and cleanup reservations occupy their applicable capacity so concurrent Guests cannot overshoot it. A completed video permanently consumes one video slot for that event.
Each event displays its controlling upload limits. A photo may be no larger than 10,485,760 bytes, displayed as “10 MB.” An entitled video may be no larger than 26,214,400 bytes, displayed as “25 MB,” and no longer than 30 seconds. The Service accepts supported JPEG, PNG, WebP, and decodable HEIF/HEIC photos and browser-compatible MP4, MOV, and WebM videos. The browser creates and uploads a JPEG poster for each video. The Service stores video files without transcoding, repairing, or guaranteeing playback on every device. We may reject malformed, unsafe, excessive, or unsupported files.
The Organizer chooses a per-device Guest allowance of 5, 10, 15, 20, or 25 photos, subject to the event-wide photo capacity. The selected video pack separately provides the per-device video allowance shown above. Clearing browser storage does not restore event-wide capacity or erase the server record associated with the prior browser identifier.
An Organizer account may use a given event date once across plans and time zones, subject only to an eligible date correction or the unused-event deletion rule. Deleting an event before Guest access opens releases that event date only if no media reservation or upload has ever existed. If Guest access has opened or any media reservation or upload has ever existed, the event date remains used for that Organizer account after deletion.
Event timing
Under the plans above, the Organizer selects an event date and time zone, not custom opening and closing times.
- Guest uploads and the optional Guest gallery open at 12:00 a.m. on the event date and close at 5:00 a.m. on the following date, measured in the selected event time zone.
- The plan’s post-event Organizer download period begins when Guest access closes at 5:00 a.m. Organizers can also access originals while Guest access is open.
- Organizer access ends at 5:00 a.m. exactly 2, 14, 30, or 90 calendar days later in the event’s selected time zone, according to the activated plan.
The exact schedule displayed for the event controls, including across daylight-saving time changes. Access ends at the stated cutoff even if a reminder is delayed or physical deletion finishes later. Reminder emails are a courtesy and are not guaranteed. Organizers are responsible for downloading all wanted media before the cutoff.
Event links and the Guest gallery
An event link is designed to be shared, not treated as a password. Anyone who receives or is forwarded the link may be able to see the event name, date, time zone, Guest access status and window, per-device allowance, upload limit, and whether the Guest gallery is enabled. While Guest access is open, link holders may upload photos and, for entitled events, short videos. If the Guest gallery is enabled, link holders may view available media originals one at a time.
The Guest gallery is enabled by default when an event is created, but the Organizer may turn it off. Gallery media appears without Organizer preapproval. Link holders may open, save, or share individual original files, which may contain embedded device details, capture time, precise location, or other metadata. The Service does not provide a Guest bulk-download or export action. Turning the gallery off or deleting an event cannot retrieve copies or screenshots that someone has already made.
Organizers are responsible for deciding who receives the event link, checking the Guest-gallery setting, and explaining the event’s media-sharing expectations to invitees.
Payments and taxes
Paid plans and optional video packs are one-time purchases for one event. A checkout may include a paid base plan, a video pack, or both. Roll the Moment does not offer a subscription, renewal, invoice billing, overage charge, coupon, or delayed payment method, and it does not use stored credentials to initiate a later charge. Stripe-hosted Checkout or an available card wallet may separately offer to remember payment information under its own terms, but every Roll the Moment purchase must be initiated and confirmed separately.
A discretionary complimentary plan grant under Section 2 is not a Stripe purchase, refund, coupon, account credit, or cash-equivalent benefit. It does not entitle the Organizer to a payment, refund, substitute event, transfer, or later grant.
Stripe hosts checkout and processes payment and automatic tax calculation. The total charge, including any tax, is displayed before payment is submitted. You authorize that one-time charge and are responsible for accurate billing information. Roll the Moment does not receive or store your full card number or security code.
A new event requiring payment remains a private draft until a verified payment notification activates it. An upgrade Checkout leaves the existing event on its prior entitlement until verified payment applies the purchased change. A checkout confirmation page by itself does not create or upgrade an event. If a verified charge cannot be safely fulfilled, we may automatically initiate a full refund rather than create an inconsistent entitlement.
Cancellations, refunds, and disputes
An unpaid checkout draft may be canceled before payment completes. Once payment has completed, cancellation is governed by this refund section.
Except where law requires otherwise, paid-plan and video-pack purchases are final. We will issue a full refund when we verify all of the following:
- the request is received within seven calendar days after purchase;
- the event’s Guest-access window has not opened; and
- no photo or video upload has been started or completed for the event.
Send a request from the Organizer account email to [email protected] with the event name or event link. We do not issue partial refunds, credits, or plan changes outside the narrow purchases described in Section 2. The discretionary complimentary exception in Section 2 is not a refund or credit. If a refund is approved, we will return the full amount charged through the original payment method; Stripe and the payment provider control when the funds appear. A refunded video add-on loses video access but leaves its base photo event in place. When the event still satisfies the pre-opening and no-media conditions, a refunded base-plan upgrade restores the event’s prior Free plan; video from the same refunded upgrade is revoked, while an earlier separately purchased video pack remains governed by its own purchase. If returning to Free is no longer safe, the affected event may instead be canceled. A refund of the original event-creation Checkout containing a paid base plan cancels that activated event and any video bought in the same Checkout.
Deleting an event does not request or automatically issue a refund. A completed refund of an original paid event cancels access; an upgrade refund instead restores, revokes, or cancels the affected entitlement as described above. A base-plan upgrade that safely returns to Free also returns to the Free Organizer download window calculated from the event’s current date and time zone. A refund does not itself delete stored media. A refund alone does not release the event date, and a separate deletion follows the unused-event deletion rule above. If payment cannot activate a new event and is automatically refunded, the unactivated draft and its temporary date reservation are released.
Please contact us before opening a payment dispute so we have an opportunity to address the issue. A dispute may restrict the account from making additional paid purchases. A dispute resolved against you may cancel access to the affected paid event, but it does not automatically delete its media. Nothing in this section limits non-waivable rights under applicable law.
Your media and permissions
You keep any ownership rights you have in photos, videos, audio, and other material you submit (“User Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, copy, process, resize, display, transmit, and delete User Content only as needed to provide, secure, support, and legally operate the Service. This license ends when the relevant User Content is deleted from our active systems, except to the extent a copy must be retained for legal reasons or remains temporarily in a restricted backup or provider system.
By uploading to an event, a Guest directs us to make the original available to the Organizer. If the Guest gallery is enabled, the Guest also directs us to display the original file, including any embedded metadata, to people with the event link and understands that they may save or share it. We do not control copies obtained by the Organizer or other link holders.
You may upload User Content only if you have the rights and permissions needed to do so. This includes any permissions reasonably required from photographers, people depicted or recorded, speakers, property owners, parents or guardians, bystanders, and event participants. Media depicting or recording children may be uploaded by an eligible adult or older teen only when the uploader has the necessary authority and consent; children under 13 may not upload it directly.
Do not upload content that is unlawful, threatening, exploitative, intentionally deceptive, infringing, malicious, or that exposes highly sensitive information such as government identifiers, payment-card data, medical records, or account credentials. Do not use the Service to harass, stalk, impersonate, or violate another person’s privacy, publicity, or intellectual-property rights.
We may remove content or restrict access when reasonably necessary to protect users, the Service, or third parties, or to comply with law. To report a copyright, privacy, or other content concern, email [email protected] with the event link, enough information to identify the media, the basis for the request, and your contact information. We may request verification and will act as required by applicable law.
Downloads, retention, and deletion
From the first upload until the event cutoff, the Organizer may download individual originals through temporary authorized links. Photo and video originals may also be requested as separate asynchronous ZIP export batches, divided into bounded parts as needed. Each export is a fixed snapshot of one media type and excludes matching originals not ready when that snapshot is created; the Organizer must request a new snapshot to include later media. Export files expire within 48 hours or at the event cutoff, whichever comes first. Organizers must confirm that downloads are complete and usable; the Service is not a permanent archive or backup.
At the event cutoff, access to event media ends and permanent cleanup is queued. Physical deletion is retryable and may finish after access has ended. If an Organizer deletes an event early, access ends immediately and cleanup is queued. Deletion is permanent and cannot be undone.
Deleting event media does not necessarily delete the Organizer account or non-media records needed for purchases, tax and accounting, policy acceptance, fraud and dispute handling, security, enforcement of account/date rules, audits, or legal compliance. The Privacy Notice explains these distinctions.
Acceptable use
You may not:
- break the law or another person’s rights;
- probe, scan, or test the Service for vulnerabilities without written permission;
- bypass capacity, device, event-window, account, payment, or access controls;
- access another Organizer’s originals or exports without authorization;
- scrape, automate, overload, disrupt, reverse engineer, or introduce malicious code into the Service, except where applicable law expressly permits an activity;
- use event links, email features, or uploads for spam, phishing, or abuse; or
- resell or commercially exploit the Service without our written permission.
Our intellectual property
The Service, including its software, design, branding, and non-user content, belongs to Circle City Coders or its licensors and is protected by law. These Terms give you only the limited right to use the Service as described here. Feedback you voluntarily provide may be used without restriction or compensation, provided we do not identify you without permission.
Availability, suspension, and changes
We may maintain, modify, suspend, or discontinue all or part of the Service. We do not promise uninterrupted availability, successful delivery of every reminder, or completion of every upload or export. Network, device, browser, and third-party-provider failures can affect the Service, and event windows are not automatically extended by an outage.
We may restrict or terminate access for a material or repeated violation of these Terms, security risk, unlawful use, payment dispute, or legal requirement. Advance notice or an opportunity to retrieve media may not be available.
Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that every media file will upload, play, or remain recoverable, or that people with an event link will handle media as the Organizer or uploader expects.
Some jurisdictions do not allow certain warranty exclusions, so some of this section may not apply to you.
Limitation of liability
To the maximum extent permitted by law, Circle City Coders and its officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost media, lost goodwill, or the conduct of Organizers, Guests, or other third parties.
Our total liability arising out of the Service or these Terms will not exceed the greater of (a) the amount you paid for the event giving rise to the claim or (b) $100.
These limits do not apply to liability that cannot lawfully be limited, and they apply only to the extent permitted in your jurisdiction.
Indemnity
To the extent permitted by law, you will defend and indemnify Circle City Coders and its officers, employees, contractors, and affiliates against third-party claims, losses, and reasonable costs arising from your User Content, your unlawful use of the Service, or your material violation of another person’s rights or these Terms. This obligation does not apply to the extent a claim was caused by our own unlawful conduct.
Governing law and disputes
Indiana law governs these Terms, without regard to conflict-of-law rules. Before filing a claim, you and Circle City Coders agree to send written notice describing the dispute and to try in good faith for 30 days to resolve it informally. Notices to us must be sent to [email protected].
If the dispute is not resolved, the state and federal courts located in Marion County, Indiana will have exclusive jurisdiction, and each party consents to those courts. This section does not prevent either party from seeking urgent injunctive relief, filing an eligible small-claims case, or exercising rights that cannot lawfully be waived.
Changes to these Terms
We may update these Terms as the Service or law changes. We will post the revised version and effective date and will request renewed acceptance when the Service or applicable law requires it. A later change will not retroactively reduce the capacity, Organizer download window, or other fixed entitlement of an already activated event.
General terms
These Terms are the entire agreement about use of the Service unless we expressly agree otherwise in writing. The Privacy Notice describes our information practices but does not replace these Terms. If part of these Terms is unenforceable, the rest remains in effect. A failure to enforce a provision is not a waiver. You may not transfer your account or these Terms without our consent. We may assign these Terms as part of a merger, reorganization, financing, sale of assets, or transfer of the Service.
